PRIVACY POLICY

1. Overview

Impact Couple Inc ("we", "us" or "our") is the sole and absolute owner of the "IMPACT PROTOCOL" application (the "Platform" or "App"), through which Gabriel Fernandez (the "Trainer"), a certified fitness trainer, and his coaching team provide training and guidance to their clients through the Platform. We have the exclusive right to develop, improve, and update the Platform at our discretion. The App is developed and maintained by FitBudd Inc., including any of its subsidiaries ("FitBudd").

We place great importance on the privacy and protection of our Users' personal data. Our practices and procedures regarding the collection and use of personal data are described below for your reference. We have implemented reasonable security practices and procedures appropriate to the type of information we protect and the nature of our business. Although we do our best to ensure the security of the information, due to the inherent vulnerabilities of the Internet, we cannot fully guarantee the security of all information transmitted through the App.

Our Privacy Policy should be read together with the Terms of Use before using the Platform or any of its services. This policy is subject to change without prior notice. To make sure you are informed of any modifications, we recommend that you review this policy periodically. By using this Platform, you accept the terms and conditions of this Privacy Policy.

We may use third-party services to provide our services. These third parties may access your information to the extent reasonably necessary and will be subject to reasonable security practices and procedures.

This Privacy Policy applies to all Users, including Clients of the Trainer and his coaching team who have registered on the Platform.

2. Information Collection

When registering on the Platform, you will be asked to create a unique username and a private password (collectively, the "Access ID") to activate your account on the Platform (the "Account").

You acknowledge and agree that, in order to provide you with the Services, personal information may be requested, such as:

  • Name
  • Age
  • Gender
  • Physical and health condition
  • Email address
  • Photographs to assess physical progress

FitBudd will store all Personal Information in accordance with applicable laws. We will take reasonable measures to prevent the disclosure of photos uploaded to the Platform, but we will not be liable if they are disclosed by third parties.

The Trainer and his coaching team may upload images and videos to improve the services offered. We are not responsible for the origin, content, or legality of such materials.

We also collect financial information such as:

  • Bank account numbers
  • Debit/credit card numbers
  • Payment data or other financial identification data

This data is collected exclusively to process payments and provide the Services in accordance with the Terms of Use. If you wish to modify or delete your Personal or Financial Information, you may contact us at impactcouple24@gmail.com.

In addition, we collect information about:

  • Pages visited within the App
  • Type of device and browser used
  • IP address and approximate location
  • Referral information (pages visited before accessing our App)

This information is collected in order to improve the Services, personalize the User experience, and enhance the security of the Platform.

3. Purpose of Information Collection

We use your Personal and Financial Information to:

  • Allow you to access and use our Platform.
  • Inform you about the progress of your training.
  • Send updates about diets and exercise plans.
  • Protect against fraud and illegal activities.
  • Comply with our legal obligations.

4. Privacy and Security

We do not sell or rent your Personal Information to third parties without your consent. However, we may share your information with affiliates, agents, and service providers for the purpose of improving the user experience.

All information on the Platform is protected by copyright and other intellectual property laws.

5. Acceptable Use

It is prohibited to attempt to:

  • Breach the security of the Platform.
  • Interfere with other Users' access.
  • Send unsolicited emails for advertising purposes.
  • Hack or access information without authorization.

Security violations may result in civil and criminal penalties.

We may send you emails about our services. If you wish to stop receiving these messages, you may unsubscribe through the link included in the emails or by sending an email to impactcouple24@gmail.com.

7. Exceptions

We reserve the right to disclose your personal information if:

  • It is required by a court order or applicable law.
  • It is requested by governmental authorities.
  • It is necessary to protect our rights or property.

Neither we, nor the Trainer, nor FitBudd are responsible for any physical injury or damage arising from the use of the App.

9. Health Insurance Portability and Accountability Act (HIPAA)

The Trainer and the App are NOT regulated by HIPAA privacy rules. Therefore, your Personal Information will not have the protection granted by this law.

10. Miscellaneous

  • International Data Transfer: Your Personal and Financial Information may be stored in other countries with data protection laws different from those of your country of residence.
  • GDPR and CCPA Compliance: We comply with the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
